These Terms of Service (“Terms”) govern your use of petmarlo.com and purchases from Petmarlo.

The website and store are operated by Andrej Gašperík, trading as Petmarlo (“Petmarlo,” “we,” “us,” or “our”).

Please read these Terms before placing an order. Nothing in these Terms excludes or limits rights or remedies that cannot be excluded under applicable law.

1. Our store and related policies

Petmarlo sells pet products through an online store hosted by Shopify. Your seller is Andrej Gašperík, trading as Petmarlo.

The following policies provide additional information relevant to your purchase and use of our website:

The Shipping Policy and Return and Refund Policy applicable when you place your order form part of the terms of that purchase. The Privacy Policy explains how we process personal information; accepting these Terms does not constitute blanket consent to marketing or tracking.

2. Eligibility and customer information

To place an order, you must have the legal capacity to enter into a purchase agreement and be authorized to use your chosen payment method.

Please provide accurate and complete contact, billing, and shipping information. You are responsible for reviewing your order details before submitting your purchase.

Customer accounts are optional. You may check out as a guest. If you use an account, keep your access credentials or sign-in codes secure and notify us if you suspect unauthorized access.

3. Products and availability

Please review each product’s description, dimensions, compatibility information, and instructions before purchasing.

We aim to describe products accurately. Screen settings may affect how colors appear, but this does not limit your rights if a product is materially different from its description.

Product availability can change. If we discover that an ordered item cannot be supplied, we will contact you and arrange an appropriate resolution, including a refund for any item we cannot provide. We will not substitute a materially different product without your agreement.

4. Prices, payments, and discounts

Prices and shipping charges are stated in U.S. dollars (USD).

The checkout displays the merchandise total, applicable shipping charges, any applicable taxes, and discounts before you submit your order.

You authorize the payment associated with the order you submit. Your payment provider may apply its own currency conversion or other charges under your agreement with that provider.

Prices may change for future purchases. A later price change does not, by itself, change the price of an order already placed.

Discounts are subject to the conditions disclosed with the offer, including eligibility, expiration dates, minimum purchase amounts, and combination rules. These Terms do not promise an automatic discount.

If we identify a material pricing or listing error affecting your order, we will contact you to explain the issue and available options. We will not charge an increased price without your agreement. If the order is cancelled, any payment collected for the cancelled items will be refunded.

5. Orders and order communications

After you submit an order, we will send an order confirmation to the email address provided at checkout.

We may contact you if information needed to process or deliver your order is missing or if a payment or security issue requires clarification.

An order may need to be declined or cancelled because of unavailable stock, an unsupported delivery address, an unresolved payment issue, suspected fraud, or another lawful reason. If we cancel an order for which payment has been collected, we will notify you and refund the cancelled portion.

6. Shipping and fulfillment

The current launch is limited to the SucceBuy Wooden Cat Exercise Wheel, 35.8-inch variant shipping from the United States, for supported street addresses in Alabama. Standard shipping for this eligible variant is free. Other variants, products, regions, additional quantities and mixed baskets are not included in this launch. There is no storewide free-shipping threshold.

Supplier delivery estimates are not guaranteed arrival dates. Petmarlo remains your seller and support contact. Refer to our Shipping Policy for delivery, tracking, delays and cancellation details.

7. Address changes and cancellation requests

If you need to correct an address or request cancellation, email hello@petmarlo.com as soon as possible with your order number.

We will review your request with the relevant fulfillment partner. Changes or cancellation cannot be guaranteed once order processing or shipment has begun. This does not limit any cancellation or refund right provided by applicable law.

If a package is returned because of an incorrect or incomplete address, we will review the available options with you. Any proposed reshipping charge will be explained before you agree to it.

8. Returns, refunds, and order problems

Our Return and Refund Policy explains the conditions and process for requesting a return or refund.

Requests involving a defective, damaged, incorrect, or materially misdescribed item are assessed separately from requests made because you changed your mind. Change-of-mind eligibility, conditions, and any applicable charges must be disclosed in the Return and Refund Policy or relevant product information before purchase.

Contact hello@petmarlo.com before sending anything back. Include your order number and a description of the issue. Photographs of the item, packaging, and shipping label may help us investigate.

Return instructions and the appropriate return destination are provided individually after authorization. Our public contact address is not an automatic return address. Please do not send a product to that address or an address on its packaging without instructions from us.

For delayed, missing, damaged, or incorrect shipments, contact Petmarlo so we can investigate and arrange an appropriate resolution. Supplier procedures do not override your applicable rights against us as the seller.

9. Product use and safety

Use products only for their intended purpose and follow the instructions and warnings supplied with them.

Choose products appropriate for your pet’s size, behavior, and needs. Supervise use where appropriate, inspect products for damage, and stop using an item if it becomes unsafe.

No pet toy should be assumed to be indestructible. Product descriptions are not a substitute for individualized veterinary advice.

These precautions do not exclude our responsibility for defective products or other obligations imposed by applicable law.

10. Warranties and responsibility

Any specific written warranty offered with a product is subject to the terms made available for that warranty.

Nothing in these Terms excludes applicable statutory warranties or remedies. A supplier’s warranty arrangements with Petmarlo do not, by themselves, determine your rights as our customer.

Website access may occasionally be interrupted for maintenance or reasons outside our reasonable control. Such interruptions do not remove our obligations concerning orders already placed.

Nothing in these Terms excludes liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded or limited.

11. Acceptable website use

You must not use the website to:

• Commit fraud or submit knowingly false transaction information.

• Access accounts, systems, or data without authorization.

• Introduce malware or interfere with website security or operation.

• Infringe another person’s intellectual property or privacy rights.

• Harass or threaten others.

• Carry out unlawful activity.

We may restrict access where reasonably necessary to address misuse or protect the store. Restricting access does not remove your rights concerning an existing purchase.

12. Website content and third-party services

Petmarlo branding and original website content belong to us or are used with permission. Other product names, trademarks, and materials belong to their respective owners.

You may use the website for personal shopping and related lawful purposes. You may not reproduce or commercially exploit protected content without the relevant rights holder’s permission.

Third-party websites or services linked from our store may have their own terms and privacy policies. Their inclusion does not change our responsibilities for products purchased from Petmarlo.

13. Electronic communications and privacy

We use the email address supplied to communicate about orders, delivery, customer support, cancellations, and refunds.

Marketing subscription is optional and is not required to purchase. You can unsubscribe from marketing emails while continuing to receive necessary order communications.

Our Privacy Policy explains our handling of personal information, including checkout information, fulfillment disclosures, email communications, and connected technologies.

14. Governing law and disputes

These Terms are governed by the laws of Slovakia, subject to any mandatory consumer protections that apply to you and cannot be excluded by a choice-of-law provision.

If you have a complaint, contact hello@petmarlo.com so we can try to resolve it.

Nothing in these Terms requires mandatory arbitration, waives a right to participate in a legally permitted collective action, or prevents you from bringing a claim before a court or authority that has jurisdiction under applicable law.

15. Changes to these Terms

We may update these Terms for future use of the website and future purchases. The updated version will display a revised date.

Changes will not retroactively reduce your rights for an order already placed. Where required, we will provide additional notice of material changes.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
